Summary / Abstract :
|
A genocide trial of the Pol Pot regime was long overdue. Unfortunately, under international law the United States could not be the nation that asked the World Court to hear the case. The US Senate gave its consent to the Genocide Convention only with a crippling reservation the article 9, the article that grants jurisdiction to the International Court of Justice. Therefore, the US could not bringsuit against another nations without that nation's consent.
